What is an Expungement?

Expungement is the removal of court and law enforcement records from public inspection. In some cases not all records can be expunged due to date of arrest and type of disposition from the courts.

The Expungement Assistance program at the WorkBaltimore Convention will provide participants with information and guidance on how to expunge criminal records from Maryland state court records only.

Who is eligible?

If you have been charged with a crime, including a traffic violation for which a term of imprisonment may be imposed, you may file a petition for expungement if:

• You were found not guilty
• The charge was dismissed
• The charge resulted in probation before judgment (excluding charges of driving while under the influence or driving while impaired)
• The State's Attorney did not prosecute (Nolle Prosequi) your charge
• The court indefinitely postponed your case (stet)
• Your case was compromised (settled)
• You were convicted of only one non-violent criminal act and you were granted a full and unconditional pardon by the Governor
• You were convicted of certain crimes more than several years ago

What minimum information is needed at the time of application?

• Name currently using and any names you may have used at the time of arrest
• Current address
• Date of birth
• Date of arrest
• Case number and tracking number
• Arresting agency
